I fell surrounded by the parkin lot of my living. can i sue i've have subsidise dull pain for 5 months immediately?
there was an icy storm reproving the day before and my company didnt verbs the parking lot until after i fell. i've been going to theraphy and it's not helping. i didnt brake any bones. im going to have an mri done surrounded by two weeks. could i sue for my pain and suffering.
Answers: I'm not so sure you can based on 2 things. Another yahoo questioner be asking how her sister could appeal the decision based on an injury similar to yours. She tripped coming out the door of an elevator that wasnt working properly (it wasn't smooth with the floor she was getting bad on). This was AT her place of business. She was on her approach into the office and this happened at 7:54am. They denied her claim base on the fact that she wasn't paid for working until 8:00am. I still only cannot believe that to be true though.
Now secondly, I know this is true, but it may vary from state to state. (I'm in Missouri). If a business tries to verbs snow/ice from their parking lot/sidewalk/door entrances, etc., and you fall, you can sue them. However, (and this is where it get ridiculous), if they have done nothing to the snow/ice, you cannot sue them or hold them liable contained by any way. Basically, if they try to do the right thing for their customers or force, they can get sued and if they sit back and do nil about the ice/snow, you can't sue them for one red cent! That's why (in my state anyway) you see so many businesses who still own ice/snow all over their parking lot and sidewalks, you can't sue them if you fall!
So, if the above woman's story is true, and if you own the same law within your state as in mine, I would say its not looking dutiful for you. As a PT myself, I'm going to tell you to keep trying the psychiatric therapy! Don't give up on it yet, and be sure to do the exercises they've shown you at home also. And patently get the MRI done, it could certainly relieve your case. Good luck to you and I hope your back get better!
If it is business related or involved, you are able to sue. Simple as that.
